1. GENERAL PROVISIONS

This site is owned by S.R.L. OPTIMATCONS. By placing an order in the online store, the Buyer accepts the Terms and Conditions of sale of goods/products and/or services based on RM legislation (hereinafter referred to as the “Terms and Conditions”) presented below. Using the website implies acceptance of the Terms and Conditions proposed by S.R.L. OPTIMATCONS, in accordance with Law No. 284/2004 on Electronic Commerce. The relationship between the client and the seller is governed by Law No. 105/2003 on Consumer Protection and other normative acts adopted in accordance with it. The seller reserves the right to modify the given Terms and Conditions, and the Buyer is obliged to monitor these changes.

2. PERSONAL DATA PROTECTION

By using the site elementdesign.md, you automatically agree to the collection and processing of personal data necessary for processing/confirming/executing orders. Personal data is processed only for legitimate purposes, such as providing the products you order, promotions, Google Analytics, cookies, and notifications/newsletters. All information containing personal data is stored and used only for the period necessary to achieve the purposes for which it was collected and in accordance with the provisions established by Law No. 133/2011 on the protection of personal data. We use commercial security measures to prevent unauthorized access, maintain the accuracy of data, and ensure the correct use of information on the site. Transmission of data over the internet or through wireless networks cannot be fully protected. Therefore, like other companies, we cannot guarantee the security of the information provided to the Buyer, who does so at their own risk.

3. ORDER REGISTRATION AND PAYMENT

Payment for orders is possible with a credit card – upon receiving the order, you will receive a receipt confirming the payment. Online payment is done with maximum security using a credit card, which allows for online transactions. After completing the payment, you will receive a payment confirmation to your email address. The payment processor uses a secure system based on the latest version of the 3D-Secure standard, which means a new global approach to authenticating buyers in secure online transactions. This security measure involves redirecting the user to a secure page where authentication for each cardholder is done by assigning a one-time code for each online transaction. Refunds are only made to the credit card used for the purchase. To make a payment, you will need to enter your credit card details. The transfer of this information is done in accordance with all necessary security measures. Information is transmitted in encrypted form and stored only on a specialized payment system server. For making the payment, the following details will be required:

Name and surname on the credit card If the currency of the card differs from the currency of the transaction (MDL), then the conditions of the issuing bank will apply to the conversion of the amount deducted from the card account.

4. DELIVERY OF PRODUCTS / GOODS / SERVICES

After the order is placed, the buyer will be provided with information regarding the estimated delivery date by the couriers / delivery service. Delivery within the Or. Chișinău area is carried out within 48 hours from the confirmation of the order by our operators. Delivery is charged 25 MDL. Delivery to the rest of the country is carried out within 72 hours from the confirmation of the order by our operators. Delivery is charged 50 MDL. Deliveries are not made on Sundays or national holidays. The delivery time may be extended in certain isolated situations (e.g., unfavorable weather conditions, legal holiday periods, unforeseen technical issues, etc.). We will notify you in advance if we encounter any of these isolated situations. You can choose any address for delivery – home, office, or any other address, without additional charges. We accept only one delivery address per order. If you need to deliver the order to different addresses, please place separate orders for each address. Upon receiving the products, please check the integrity of the packaging and the presence of the receipt in the presence of the courier. Any subsequent claims regarding these aspects will not be accepted.

5. RIGHT TO RETURN

According to the provisions of Law No. 105-XV of March 13, 2013, on Consumer Protection, the Buyer has the right to return the purchased product/good for certain reasons within 14 days from the date of payment. The funds will be refunded to the card used for the purchase. Freshly prepared products cannot be exchanged or returned, in accordance with Annex No. 2 of Government Decision No. 1465 of December 8, 2003 (MO248-253/19.12.2003), as amended by Government Decision No. 1188 of November 2, 2007 (MO175/09.11.2007). 6. PRIVACY POLICY

In accordance with the provisions of Law No. 133/2011 on the Protection of Personal Data, the service provider processes personal data. Personal data is processed in good faith and in accordance with legal provisions. The processing of personal data is carried out through mixed means (automated and manual), adhering to legal requirements and conditions that ensure security, confidentiality, and respect for the rights of the data subjects. The provider collects and processes only the personal data provided by consumers when placing an order: name, surname, phone number, address, postal address. Personal data is used solely for the purpose of managing the site, providing access to special information, delivering orders, or contacting the consumer for delivery execution. By this notice, users and consumers acknowledge that their personal data (name, surname, phone number, address, postal address) will be processed and used. The service provider processes the personal data of users and consumers provided through browsing, using, and registering on the site. Any information provided by users and consumers of the site will be considered as explicit consent for the data to be used by the provider. The provider will not disclose any of the data held to third parties without the consent of the data subjects and will not sell, exchange, or disclose this data to other persons, except as provided by current legislation (upon request by state public institutions, law enforcement agencies, courts, and other authorized entities to process personal data). Personal data may also be processed and used by the provider for statistical and promotional purposes. The service provider meets the requirements for personal data security and ensures the protection of consumer data, safeguarding it from loss, destruction, distortion/falsification, or disclosure to third parties. The service provider’s employees are required to maintain the confidentiality of consumer personal data. The processing of personal data will be carried out by the authorized person of the provider. The provider uses security methods and technologies in accordance with current legal provisions. The provider does not collect transaction-related information, such as card number, expiration date, country of origin.
